A number of amendments were made to the regulations governing the State of Disaster in South Africa that could affect your business. The amendments came into effect on 1 February 2022. Take note of the following changes and make adjustments to your own policies around COVID-19 should any of the amendments impact these.
Below are some of the changes to the regulation: (please note this is a summation only and not a comprehensive legal guide or original copy of the amendment. This can be obtained here: https://rcci.co.za/amendment-of-regulations-issued-in-terms-of-section-272-of-the-disaster-management-act-2002/):
- Anyone that is confirmed COVID-19 positive by a laboratory may not refuse treatment and a warrant can be acquired to enforce this.
- Individuals who are confirmed COVID-19 positive by a laboratory but are asymptomatic, are not required to isolate anymore
- Those who do display symptoms are required to isolate for seven days or for a longer period as determined by a medical professional
- Individuals who are confirmed COVID-19 positive by a laboratory and are symptomatic are required to comply to isolation requirements or received treatment in a health facility, if deemed necessary by a medical professional, and the magistrate can intervene if one does not comply.
